16. Dispute Resolution

16.1 Informal Resolution

Both parties agree to negotiate in good faith to reach a mutually satisfactory resolution.

16.2 Binding Arbitration

If informal resolution is unsuccessful, you and Dions agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved through binding arbitration, rather than in court, in accordance with the rules of the American Arbitration Association (AAA). You and Dions each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entire arbitration provision shall be void and any claims must be brought in a court of competent jurisdiction.
